El emplazamiento del Club de Mar diseñado por el arquitecto Ignacio García para Río Real Golf Hotel Marbella se encuentra fuera de la zona de servidumbre de protección del Dominio Público Marítimo Terrestre (DPMT).
El documento de la Memoria del Proyecto de Deslinde del DPMT consultado en la sede provincial de Demarcación de Costas Andalucía – Mediterráneo de Málaga determina que la anchura de la zona de servidumbre de protección ha de computarse, conforme a la aplicación del artículo 23 de la Ley y 43 del Reglamento, desde el borde interior de la ribera del mar, y que se debe determinar, conforme a la legislación vigente, en función de la clasificación urbanística de los terrenos colindantes con el DPMT, reconocida por la administración urbanística competente, y existente a la fecha de entrada en vigor de la Ley 22/88, de 28 de julio, de Costas.
La legislación citada establece que la anchura de la zona de servidumbre de protección se extiende cien metros, tierra adentro, en suelos clasificados como no urbanizable o urbanizable sin plan parcial aprobado definitivamente a la entrada en vigor de la Ley de Costas, y veinte metros en terrenos clasificados como urbano – como sucede en los terrenos del emplazamiento del club de mar – o urbanizable con plan parcial aprobado definitivamente a la entrada en vigor de dicha Ley.

El plano del Proyecto de Deslinde del DPMT del tramo de costa comprendido desde la margen derecha del Río Guadalpín hasta la margen izquierda del Río Real en Marbella, facilitado por Demarcación de Costas, recoge la información cartográfica, con proyección y coordenadas U.T.M. – Huso 30, de la línea de ribera de mar, la línea de deslinde del DPMT, el límite de servidumbre de tránsito y el límite de servidumbre de protección. Ninguno de estos límites impide la construcción del Club de Mar que ha diseñado Ignacio García en terrenos del campo de golf de Río Real.

The emplacement of the Beach Club designed by the architect Ignacio García for the promoter Río Real Golf Hotel Marbella is not in the zone of protection of the Public Maritime Terrestrial Domain (DPMT).

The mentioned legislation establishes that the width of the zone of protection spreads one hundred meters in the area called not urbanizable or in the area that is urbanizable but has not partial plan approved definitively to the entry into force of the Law of Coasts, and twenty meters in urban areas - as the emplacement of the proposed beach club - or area urbanizable that has partial plan approved definitively to the entry into force of the above mentioned Law.
The planning document of the Project of Demarcation of the DPMT of the section of coast understood from the right side of the Río Guadalpín up to the left side of the Río Real in Marbella facilitated by Demarcation of Coasts, includes the cartographic information, with projection in U.T.M. - Spindle 30, of the line of bank of sea, the line of demarcation of the DPMT, the limit of servitude of traffic and the limit of protection servitude. None of the limits affects the construction of the Beach Club that Ignacio García has designed in the golf course of Río Real.
